Getting an Uber home from your fave bar may be getting a little bit more complicated.

Uber recently submitted a patent for a feature that can tell if it’s users are drunk by the way they’re using their phones. The patent is called ‘Predicting User State Using Machine Learning’ and uses certain info such as how many typos you make, how fast you’re walking, and even the buttons and and links you click on to determine whether or not you’re in an ‘abnormal state’. Essentially, this feature would give drivers the technology to discriminate against who they want to pick up, which is upsetting a lot of critics, especially since so many people use Uber as an alternative to driving after drinking.

Uber, however, claims that they submit many patent ideas but not all of them become features.
